1. Overview
Regulate Inc. (Regulate, we, us, or our) owns and operates the website at regulate.care (the Website) and any affiliated mobile application (the App). The Website and App (collectively, the Sites) are provided to facilitate access to our services (the Services) for registered users. Accessing or using the Sites constitutes your acceptance of these Terms of Service and all policies, conditions, and notices referenced herein. If you do not agree with these Terms, you must immediately cease accessing or using the Sites and Services.
2. Updates to the Terms
We may modify these Terms at any time by posting the revised version on the Website or by notifying registered users via email at support@regulate.care. Your continued use of the Sites after such modifications indicates your acceptance of the updated Terms. It is your responsibility to review these Terms periodically.
3. Accounts and Membership
- Eligibility: You must be at least 18 years old to register for an account.
- Account Information: By creating an account, you warrant that you meet this age requirement and agree to maintain accurate, current, and complete account information.
- Responsibility: You are solely responsible for safeguarding your account credentials and for all activities that occur under your account.
- Enforcement: Regulate reserves the right to suspend or terminate accounts for any breach of these Terms, including providing false or misleading information or engaging in any activity that harms our reputation or the integrity of the Sites. We may block your email or IP address to prevent further registration in cases of repeated violations.
4. Privacy
Your use of the Sites and Services is also governed by our Privacy Policy, which is incorporated herein by reference. Please review the Privacy Policy at regulate.care/privacy-policy to understand our practices regarding the collection, use, and disclosure of your personal information.
5. Nature of the Services
Regulate Care operates a telehealth clinical care platform that supports medical evaluation, care coordination, and ongoing metabolic health follow-up. Clinical services are provided by licensed clinicians or affiliated medical groups where applicable. Regulate Care is not a pharmacy and does not manufacture, compound, dispense, or ship medication. Healthcare decisions should be made in consultation with a licensed professional.
6. Consent to Telemedicine Services
- With your explicit consent, Regulate may collect and share your health data with clinicians, affiliated medical groups, and other service providers as needed to facilitate telehealth clinical services.
- Data exchanges will be conducted under strict security protocols.
- Licensed clinicians remain responsible for clinical decision making, including whether treatment is medically appropriate and whether a prescription is issued.
7. Relationship with Regulate
- The Sites and Services support telehealth clinical care, education, and care coordination.
- Regulate Care does not operate as a pharmacy and does not sell, compound, dispense, or ship medication.
- Communications from Regulate, including notifications and disclosures, are for informational purposes only; you assume full responsibility for monitoring and acting upon them.
8. Content and Permitted Use
- The content available on the Sites is provided for general informational purposes only.
- Regulate does not guarantee the accuracy, completeness, or reliability of any information provided.
- You agree to use the Sites and Services solely for personal, noncommercial, and nonmedical purposes.
- You are prohibited from selling, reproducing, distributing, modifying, or otherwise exploiting any content from the Sites without our explicit consent.
- Automated data extraction techniques are expressly forbidden.
9. Reservation of Rights
All rights not expressly granted herein remain with Regulate. This includes any intellectual property or proprietary rights related to the Sites, the App, and their content.
10. Billing and Payments
- Fees: You agree to pay all applicable fees for the Services in accordance with our pricing and billing terms.
- Auto-Renewal: For subscriptions with auto-renewal, charges will be applied based on the term selected.
- Verification: We reserve the right to verify your identity and adjust product offerings or pricing at our discretion.
- Order Changes: We may cancel or limit orders at our sole discretion; any changes will be communicated to you at support@regulate.care.
11. Insurance Payments
We accept insurance for our Services. However, if an insurance claim is denied or does not cover the full cost, you are responsible for paying any remaining balance. You authorize us to process your insurance claim, and in the event of nonpayment by the insurer, you agree to settle the outstanding amount directly.
12. Support and Product Issues
- Support: Our support team is available to assist you with any issues or questions regarding the Services.

- Resolution: We are committed to providing prompt and effective assistance and addressing your concerns in accordance with our refund policy.
13. Electronic Communications

- Fees: Any fees for such communications are your responsibility.
- Opt-Out: Consent is not a condition for purchasing any product or service from Regulate.

- Text Messages: To opt out of text messages, respond with your desire to opt out or email support@regulate.care.

15. Users Outside the United States
While these Terms reflect Regulate’s standard communication practices, we will comply with local data privacy and communication laws in jurisdictions outside the United States, including any applicable opt-in requirements.
16. Prohibited Uses
- You agree not to use the Sites for any unlawful purposes, including but not limited to:
- Violating any applicable laws
- Infringing upon the rights of others
- Transmitting malicious code
- Harassing or defaming others
- Engaging in deceptive practices
- Attempting to circumvent security measures

- Regulate does not endorse or assume responsibility for the content, privacy policies, or practices of any third parties.

18. Disclaimer of Warranties and Limitation of Liability
- As-Is Basis: The Services are provided on an as-is and as-available basis without any warranties, express or implied.
- No Guarantee: Regulate does not guarantee uninterrupted, error-free, or secure access to the Services.
- Liability: In no event shall Regulate or its affiliates be liable for any indirect, incidental, punitive, or consequential damages arising from your use of the Services.
- Limitation: Our total liability shall be limited to the maximum extent permitted by applicable law.
19. Indemnification
You agree to indemnify and hold harmless Regulate, its affiliates, directors, employees, agents, and contractors from any claims, damages, or expenses arising from your breach of these Terms or your use of the Services.
20. Termination
- Right to Terminate: Either party may terminate these Terms at any time.
- Effect: Termination of your account will not affect any obligations incurred prior to the termination date.
- Breach: If you violate any provision of these Terms, Regulate reserves the right to immediately suspend or terminate your account without notice.
- Responsibility: You remain liable for all fees accrued up to termination.
21. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the United States and the State of Delaware, without regard to conflicts of law principles.
22. Notices
- Method: All notices, disclosures, and communications under these Terms will be provided by Regulate either through a general notice on the Sites or via email at support@regulate.care.
- Effective Date: Notices are effective upon posting or delivery.
23. Relationship of the Parties
Nothing in these Terms creates a partnership, joint venture, agency, or employment relationship between you and Regulate. You may not bind Regulate in any manner.
24. Assignment
- Restrictions: You may not assign or transfer your rights or obligations under these Terms without our prior written consent.
- Regulate’s Rights: Regulate may assign these Terms without notice to you.
25. Severability
If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall remain in full force and effect.
26. Pharmacy Services
- Collaboration: In markets where Regulate partners with third-party pharmacies, you authorize Regulate to provide the necessary information to facilitate prescription routing and pharmacy fulfillment.
- Subject to Policies: The provision of pharmacy services is subject to the policies of the third-party provider. Pricing, insurance processing, pharmacist review, dispensing, shipping, and availability are handled by the dispensing pharmacy.
27. Packaging and Fulfillment
If medication is prescribed, packaging and fulfillment are handled by the dispensing pharmacy, not Regulate Care. Please review the pharmacy's packaging, safety, and delivery information when placing any medication order.
28. Digital Millennium Copyright Act (DMCA)
- Copyright Infringement: Regulate respects the intellectual property rights of others. We reserve the right to remove any content that infringes on copyrights.
- Reporting Infringement: If you believe that your copyrighted work has been improperly copied on the Sites, please send a notification containing the required information to support@regulate.care.
30. Effective Date
These Terms of Service are effective as of March 30, 2025 and remain in effect until terminated by either you or Regulate.
